Article 2 — Definitions
- Customer: any person, whether a consumer or a professional customer, who places an order on the website.
- Consumer: a natural person who acts for purposes that fall outside their commercial, industrial, craft, professional or agricultural activity.
- Professional customer: a natural or legal person who acts for purposes that fall within their activity (automotive trimmer, upholsterer, bodywork specialist, garage, restorer, reseller, etc.).
- Products: products for the care, repair and renovation of leather, faux leather and plastic, together with accessories and applicators sold on the website.
- Personalised products: leather paints, paints and dyes made to the customer's order, from a reference in the SOFOLK colour chart, a manufacturer reference or a sample supplied by the customer.
- Order: the contract of sale concluded between SOFOLK and the customer on the website.
- Website: the website www.renovation-du-cuir.fr.
Article 3 — Scope and acceptance
3.1. The T&Cs apply to every order placed on the website, whatever the country of delivery. They prevail over any other document issued by the customer, unless special conditions have been accepted in writing by SOFOLK.
3.2. The customer declares that they have the legal capacity to enter into contracts. They read the T&Cs before ordering and accept them by ticking the box provided for that purpose. The T&Cs are accessible at any time on the website and can be downloaded and printed.
3.3. SOFOLK may amend the T&Cs at any time. The version that applies is the one in force on the date of the order, which is attached to, or accessible from, the confirmation e-mail.
3.4. These T&Cs are in force from 5 November 2026.
Article 4 — Products and information
4.1. The essential characteristics of the products (composition, volume, compatible surfaces, instructions for use, safety pictograms) are set out on each product page, in accordance with Articles L.111-1 and L.221-5 of the French Consumer Code. Safety data sheets are available on request.
4.2. Photographs and colour renderings displayed on screen are indicative: the appearance of a colour varies depending on the screen, the light and the surface.
4.3. For advice on choosing a product or a colour, customer service can be reached using the contact details in Article 1.
4.4. Offers are valid while stocks last. If a product becomes unavailable after the order has been placed, the customer is informed without delay. They may then choose another product or cancel the order, with a refund of the sums paid within 14 days at the latest.
Article 5 — Personalised products (custom colours)
5.1. Colour chosen from the colour chart or by reference. The customer is solely responsible for choosing their reference. SOFOLK makes the product in accordance with the reference given when the order is placed.
5.2. Colour made from a sample. The sample supplied by the customer is analysed with a spectrophotometer. The colour produced is applied to a comparable material and then checked again. It is dispatched only if the measured difference is within the tolerance set out in Article 5.3.
5.3. Colour tolerance. A colour difference of no more than ΔE ≤ 1, measured with a spectrophotometer, is inherent to manufacturing and does not constitute a lack of conformity. The final result may also vary depending on the condition, porosity and preparation of the surface, the number of coats and the finish.
5.4. No right of withdrawal. Personalised products are made to the customer's specifications. They are excluded from the right of withdrawal (Article L.221-28, 3° of the French Consumer Code). The statutory guarantees in Article 14 remain applicable.
Article 6 — Precautions for use and compatibility tests
6.1. The materials to be treated vary widely: composition, surface treatments, previous care products, ageing. Before any application, the customer carries out a test on an inconspicuous area of the surface, for each product, following the instructions for use.
6.2. The customer complies with the instructions for use and safety instructions set out on the label, the product page and, where applicable, the safety data sheet (ventilation, protective equipment, drying times, storage out of the reach of children).
6.3. SOFOLK is not liable for damage caused to the surface where it results from the absence of a prior test, failure to follow the instructions for use or the safety instructions, or use on a surface for which the product is not intended. This clause does not limit the consumer's rights under the statutory guarantees.
Article 7 — Customer account and order
7.1. Every order requires a customer account. Creating one requires the customer's surname, first name and e-mail address and a password, which the customer keeps confidential.
7.2. The order process comprises the following steps:
- selection of the products and, for personalised products, entry of the reference or of the information about the sample;
- checking of the basket: products, quantities, prices, delivery costs and, where applicable, import duties and taxes;
- entry of the billing and delivery addresses and choice of the delivery method;
- acceptance of the T&Cs by ticking a box;
- confirmation by clicking the “Pay for my order” button, followed by payment.
7.3. The customer may correct input errors until final confirmation. The sale is concluded once the payment is validated. SOFOLK then sends a confirmation e-mail setting out the order summary and the applicable T&Cs, followed by a dispatch e-mail.
7.4. The data recorded by SOFOLK and its payment service providers constitute evidence of the nature, content and date of the order, unless proven otherwise. Orders are archived in conditions that guarantee their integrity. For any order of €120 or more, the customer may obtain a copy of their contract for 10 years (Article L.213-1 of the French Consumer Code).
7.5. SOFOLK may refuse or cancel an order for a legitimate reason, in particular a previous payment dispute, suspected fraud or an order that is abnormal because of its quantity. Any sums paid are then refunded in full.
7.6. The customer tracks their order from their customer account, under “My orders”.
Article 8 — Prices
8.1. Prices are stated in euros, inclusive of all taxes (including VAT), excluding delivery costs. Delivery costs are displayed before the order is confirmed.
8.2. For deliveries within the European Union, the VAT applied is that of the country of delivery where the regulations so require. For deliveries outside the European Union, prices may be invoiced excluding French VAT; import duties and taxes are dealt with in Article 11.
8.3. The price payable is the price displayed at the time the order is confirmed. SOFOLK may change its prices at any time, without effect on orders already confirmed.
8.4. Any announced price reduction is calculated from the lowest price charged by SOFOLK during the 30 days preceding the reduction (Article L.112-1-1 of the French Consumer Code).
Article 9 — Payment and retention of title
9.1. Payment is due when the order is placed. Online payment is handled by the provider Stripe, which offers a wide range of payment methods (including bank card, electronic wallets and payment in instalments); these methods vary according to the customer's language and country. The customer may also pay by bank transfer or by cheque. The methods available for an order are displayed before it is confirmed.
9.2. Online payments are processed by certified providers, using encrypted connections and, for bank cards, strong customer authentication (3-D Secure). SOFOLK never has access to the full card details.
9.3. Payment in instalments is subject to the terms of the provider concerned, which the customer accepts at the time of payment. If the provider refuses it, the order is cancelled.
9.4. In the case of payment by bank transfer or cheque, the order is processed once payment is received. If no payment is received within 7 days, the order is cancelled.
9.5. SOFOLK may suspend the processing and delivery of an order if a payment authorisation fails or is refused.
9.6. Retention of title. The products remain the property of SOFOLK until the price has been paid in full. This clause does not prevent the transfer of risk provided for in Article 12.
Article 10 — Delivery
10.1. The products are delivered to the address or pick-up point given by the customer when ordering. The customer checks that this information is correct; SOFOLK is not liable for any delay or failed delivery caused by an incorrect or incomplete address. A further dispatch is then invoiced at the rate in force.
10.2. The indicative lead times below run from confirmation of payment. The precise lead time that applies is displayed before the order is confirmed.
| Zone | Carriers | Preparation | Indicative transit time |
|---|---|---|---|
| Mainland France | Colissimo, home delivery or pick-up point | 1 to 2 working days | 48 working hours |
| Islands, overseas territories and destinations requiring air transport | Colissimo | 1 to 2 working days | Up to 15 working days |
| European Union | UPS, home delivery or pick-up point | 1 to 2 working days | 2 to 8 working days |
| Outside the European Union | UPS | 1 to 2 working days | 5 to 15 working days, excluding customs clearance |
| Personalised products | Depending on the zone | Manufacture in 2 to 10 working days (2 to 5 working days for professional customers holding a SOFOLK account), from receipt of the sample where applicable | Depending on the zone |
10.3. Where no date or time limit is stated, SOFOLK delivers to the consumer no later than 30 days after the contract is concluded (Article L.216-1 of the French Consumer Code). If this time limit is exceeded, the consumer may instruct SOFOLK, in writing, to deliver within an additional reasonable period. If delivery does not take place within that period, the consumer may terminate the contract and obtain a refund of all sums paid within 14 days (Articles L.216-6 and L.216-7).
10.4. Pick-up point. A parcel not collected within the period for which the carrier holds it is returned to SOFOLK. It may be re-sent at the customer's request, at the customer's expense. If no request is made within 30 days, the order is cancelled and refunded, less the delivery and return costs actually incurred.
Article 11 — Deliveries outside France
11.1. The countries served are listed on the website at the time of ordering.
11.2. Outside the European Union (in particular Switzerland and the United Kingdom) and to French overseas departments and territories located outside the EU fiscal territory, the customer is the importer of the products. Customs duties, import taxes and customs clearance fees are borne by the customer and payable to the carrier or to the authorities of the country of destination, unless otherwise stated before the order is placed. The customer checks that the products can be imported into their country. A parcel refused for non-payment of these charges is treated as an unclaimed parcel (Article 10.4).
11.3. Regulated materials. Certain products (solvents, resins, aerosols, flammable products) are subject to transport restrictions. SOFOLK may refuse to ship them to certain destinations or may require a suitable method of transport. The customer is informed before the order is confirmed or, failing that, as soon as possible afterwards; they may then cancel the products concerned free of charge.
Article 12 — Transfer of risk and receipt
12.1. Consumers. The risk of loss of or damage to the products passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier proposed by SOFOLK, takes physical possession of them (Article L.216-4 of the French Consumer Code).
12.2. On receipt, the customer checks the condition of the parcel. If the parcel is damaged, opened or incomplete, the customer is asked to enter precise reservations with the carrier and to inform SOFOLK within 3 days, with photographs in support. For a consumer, this step makes it easier to deal with the dispute but is not a condition of their rights under Article 14.
Article 13 — Right of withdrawal (consumers)
13.1. Time limit. In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer has 14 days to withdraw, without giving any reason and without penalty. This period runs from receipt of the products by the consumer or by a third party designated by the consumer. For an order of several products delivered separately, it runs from receipt of the last product. A period that would expire on a Saturday, a Sunday or a public holiday is extended until the next working day.
13.2. Exercise. The consumer notifies their decision before the period expires, using the form in Annex 1 or any unequivocal statement, sent by e-mail to support [at] sofolk.fr or by post to SOFOLK, Service retours, 7 chemin de Lartigot, ZI La Palu, 33360 Latresne, France. SOFOLK acknowledges receipt of the withdrawal without delay, by e-mail.
13.3. Return of the products. The consumer returns the products to the above address no later than 14 days after communicating their decision. Return costs are borne by the consumer. The products must be carefully packed to avoid any leakage or breakage during transport, in particular liquids.
13.4. Refund. SOFOLK refunds all sums paid, including the initial delivery costs, no later than 14 days after being informed of the decision to withdraw. SOFOLK may defer the refund until it has received the products back or until the consumer has provided proof of having sent them, whichever occurs first. If the consumer chose a more expensive delivery method than the standard method offered, the additional cost is not refunded. The refund is made using the payment method used for the order, unless the consumer expressly agrees to another method, at no cost to the consumer. Any delay is subject to the increases provided for in Article L.242-4 of the French Consumer Code.
13.5. Diminished value. The consumer is liable only for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning (Article L.221-23). A product that has been opened and partly used may therefore give rise to a deduction proportionate to its diminished value, up to the full price if it can no longer be used.
13.6. Exceptions. The right of withdrawal cannot be exercised, in accordance with Article L.221-28 of the French Consumer Code, for:
- personalised products made to the consumer's specifications (Article 5);
- products which, after delivery and by their nature, are inseparably mixed with other items.
Article 14 — Statutory guarantees
14.1. Irrespective of any commercial guarantee, SOFOLK is bound by:
- the statutory guarantee of conformity, under the conditions of Articles L.217-1 to L.217-32 of the French Consumer Code;
- the guarantee against hidden defects, under the conditions of Articles 1641 to 1649 of the French Civil Code.
The conditions for enforcing these guarantees are set out in the box in Annex 2.
14.2. Enforcement. The customer contacts customer service (Article 1), stating their order number, describing the defect and, if possible, providing photographs. SOFOLK tells them what to do. The cost of returning a defective product is borne by SOFOLK.
14.3. Personalised products. A colour that matches the chosen reference and the tolerance in Article 5.3 is not a lack of conformity. The choice of reference and variations linked to the surface (Article 5.3) are the customer's responsibility.
14.4. The guarantees do not cover damage resulting from use that does not comply with the instructions for use, failure to carry out a prior test (Article 6), poor storage (frost, heat, a badly closed bottle) or a product used beyond its expiry date.
Article 15 — Liability and force majeure
15.1. SOFOLK is responsible for the proper performance of its obligations. Its liability cannot be incurred where non-performance is attributable to the customer (in particular in the event of failure to comply with Articles 5 and 6), to the unforeseeable and insurmountable act of a third party, or to an event of force majeure within the meaning of Article 1218 of the French Civil Code.
15.2. SOFOLK is not liable for disruptions linked to the internet network (interruption, intrusion, viruses) that are not attributable to it.
15.3. No provision of these T&Cs has the effect of removing or reducing the consumer's right to compensation where SOFOLK fails to meet its obligations.
Article 16 — Return of samples
16.1. At the customer's request, SOFOLK returns to them the samples entrusted to it for custom manufacture. SOFOLK bears the cost of postage at the standard rate, without delivery against signature or insurance, up to a limit of €10 including VAT.
16.2. Dispatch with options (enhanced tracking, insurance, delivery against signature) is possible on request, the additional cost being borne by the customer.
16.3. Samples not claimed within 3 months of dispatch of the order may be destroyed.
Article 17 — Intellectual property
The website and its content (trademarks, logos, colour chart, photographs, videos, texts, tutorials) are the exclusive property of SOFOLK or its partners. Any reproduction, representation or adaptation, in whole or in part, without the prior written authorisation of SOFOLK is prohibited and constitutes infringement. Ordering products confers no right over these elements.
Article 18 — Personal data
18.1. SOFOLK, as data controller, collects the data needed to manage orders, delivery, payment, fraud prevention, customer service and, with the customer's consent or within the limits of the law, direct marketing. This processing is based on performance of the contract, legal obligations, SOFOLK's legitimate interest or consent.
18.2. The data is intended for SOFOLK's departments and its service providers (hosting, payment, transport, e-mail sending), within the limits of their assignments. It is kept for the duration of the commercial relationship and then archived for the statutory periods.
18.3. In accordance with Regulation (EU) 2016/679 (GDPR) and French Act no. 78-17 of 6 January 1978, as amended, the customer has the right of access, rectification, erasure, restriction, portability and objection, as well as the right to give instructions concerning the use of their data after their death. They exercise these rights by e-mail to rgpd [at] sofolk.fr or by post to the registered office address. They may lodge a complaint with the CNIL (www.cnil.fr).
18.4. A consumer who does not wish to be the subject of direct marketing by telephone may register free of charge on the Bloctel opt-out list (www.bloctel.gouv.fr).
18.5. Details of the processing and the use of cookies are set out in the website's privacy policy.
Article 19 — Complaints and mediation
19.1. Any complaint is sent in writing to customer service (Article 1). SOFOLK undertakes to reply within 15 days.
19.2. If there is no reply or no amicable agreement, the consumer may have recourse, free of charge, to consumer mediation, in accordance with Articles L.611-1 et seq. of the French Consumer Code. SOFOLK's mediator is:
CMAP — Centre de Médiation et d'Arbitrage de Paris, consumer mediation department
39, avenue Franklin D. Roosevelt, 75008 Paris
Website: www.cmap.fr (online referral form) — e-mail: consommation@cmap.fr
19.3. A mediation request is admissible if the consumer can show that they have first made a written complaint to SOFOLK and refers the matter to the mediator within one year of that complaint. It is inadmissible if it is manifestly unfounded or abusive, if the dispute has already been examined or is being examined by another mediator or by a court, or if it falls outside the mediator's remit (Article L.612-2).
19.4. Recourse to mediation is optional: the parties remain free to accept or refuse the solution proposed and to bring the matter before a court.
Article 20 — Governing law, language and jurisdiction
20.1. The T&Cs and sales concluded on the website are governed by French law. For a consumer resident in another country, this choice does not deprive them of the protection of the mandatory provisions of the law of their country of habitual residence, where that law applies to them (Regulation (EC) no. 593/2008, known as “Rome I”, Article 6). The Vienna Convention on the International Sale of Goods is excluded.
20.2. The T&Cs are drafted in French. Translations are provided for information only; in the event of any discrepancy, the French version prevails, subject to the mandatory provisions applicable to the consumer.
20.3. Consumers. The consumer may bring proceedings, at their choice, before the court of the place where they were living when the contract was concluded or when the harmful event occurred, or before any other court having jurisdiction under the law (Article R.631-3 of the French Consumer Code). A consumer resident in another Member State of the European Union may bring proceedings before the courts of their domicile (Regulation (EU) no. 1215/2012, Article 18). For a low-value dispute, they may use the European Small Claims Procedure.
20.4. Professional customers. Disputes with a professional customer fall under Part II (Article 27).
20.5. If a provision of the T&Cs is declared void or unenforceable, the other provisions remain in full force and effect.
Part II — Special conditions for professional customers
This Part applies to professional customers within the meaning of Article 2. It constitutes the basis for commercial negotiation within the meaning of Article L.441-1 of the French Commercial Code. The provisions of Part I reserved for consumers do not apply to them.
Article 21 — Professional account and prices
21.1. Access to professional prices is subject to the opening of a professional account, on production of proof of business activity (Kbis extract or registration with the trades register, intra-Community VAT number). SOFOLK may refuse or close an account for a legitimate reason.
21.2. Professional prices are stated exclusive of tax. Intra-Community deliveries to a professional customer registered for VAT in another Member State are invoiced exempt from VAT, provided that their VAT number is valid. Discounts and, where applicable, the minimum order value are specific to each professional customer; they appear on their quotes, order forms or invoices.
Article 22 — No right of withdrawal
The right of withdrawal provided for in Article 13 does not benefit professional customers. Any return is subject to the prior written agreement of SOFOLK.
Article 23 — Payment and late payment
23.1. Orders are payable in cash, when the order is placed. Different payment terms may be granted by SOFOLK on a case-by-case basis; they then appear on the order form and on the invoice. The payment period may in no circumstances exceed 60 days from the invoice date, or 45 days end of month (Article L.441-10 of the French Commercial Code). No discount is granted for early payment.
23.2. Any late payment automatically entails, from the day after the due date and without formal notice:
- late-payment penalties at the interest rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points;
- a fixed compensation payment for recovery costs of €40 per invoice (Articles L.441-10 and D.441-5 of the French Commercial Code), without prejudice to additional compensation on production of supporting documents;
- suspension of current orders and deliveries.
Article 24 — Delivery, transfer of risk and receipt
24.1. Delivery times are indicative. Failure to meet them cannot give rise to cancellation of the order or to compensation, except where the delay exceeds 30 days after a formal notice that has gone unheeded.
24.2. Risk passes to the professional customer as soon as the products are handed to the carrier. In the event of damage or missing items, the customer must enter precise reservations on the delivery note and confirm them to the carrier by registered letter within 3 days of receipt (Article L.133-3 of the French Commercial Code), with a copy to SOFOLK.
24.3. Any complaint relating to an apparent defect or to non-conformity of the delivery with the order must be sent to SOFOLK in writing within 8 days of receipt. After that period, the products are deemed to have been accepted.
Article 25 — Guarantee
25.1. SOFOLK guarantees the professional customer against hidden defects under the conditions of Articles 1641 et seq. of the French Civil Code. This guarantee is limited, at SOFOLK's choice, to replacement or refund of the products recognised as defective, to the extent permitted by law.
25.2. The professional customer, as a specialist in application, is the sole judge of the suitability of the products for their surfaces and their work. They undertake to carry out the tests provided for in Article 6 before any application.
Article 26 — Limitation of liability
SOFOLK's liability towards a professional customer is limited to direct and foreseeable damage, and capped at the amount, exclusive of tax, of the order concerned. SOFOLK is not liable for indirect damage, such as loss of business, of customers or of turnover, or for the cost of labour to redo the work. This limitation does not apply in the event of gross negligence or wilful misconduct, or in the event of personal injury.
Article 27 — Competent jurisdiction
Any dispute with a professional customer relating to the formation, performance or interpretation of sales is governed by French law and falls within the exclusive jurisdiction of the courts within the territorial jurisdiction of the Bordeaux Court of Appeal, including in the case of multiple defendants or third-party proceedings. The parties will first endeavour to settle their dispute amicably.
Annex 1 — Withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.)
To SOFOLK, Service retours, 7 chemin de Lartigot, ZI La Palu, 33360 Latresne, France — support [at] sofolk.fr:
I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract of sale of the following goods:
- Ordered on (*)/received on (*): ……………………
- Name of consumer(s): ……………………
- Address of consumer(s): ……………………
- Signature of consumer(s) (only if this form is notified on paper): ……………………
- Date: ……………………
(*) Delete as appropriate.
Annex 2 — Statutory guarantees
The consumer has a period of two years from delivery of the goods to enforce the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.
The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the consumer's request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair of the goods but the seller imposes replacement, the statutory guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction of the purchase price by keeping the goods, or terminate the contract and be refunded in full against return of the goods, if: 1° the professional refuses to repair or replace the goods; 2° the repair or replacement of the goods takes place after a period of thirty days; 3° the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of collecting or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° the lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a reduction of the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or immediate termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand. The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for the purpose of repair or replacement suspends the guarantee that remained to run until the repaired goods are delivered.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who, in bad faith, obstructs the enforcement of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund against return of the goods.
Box drawn up on the basis of the model annexed to Article D.211-2 of the French Consumer Code (paragraphs on digital content and services omitted, as not applicable to SOFOLK products).
